NAWRA member Good Law Project is a non-profit that uses the law to build a fairer future. You are probably already aware of the scandal around carer’s allowance and the way in which overpayments are being clawed back by the Department of Work and Pensions. Good Law Project think the government may be acting unlawfully in the way it is doing this.
They are trying to find affected individuals from all over the UK, and examples of how the Department for Work and Pensions is reclaiming overpayments to help them build a legal case. They are looking for the following:
a. Someone who received notice from the DWP that the DWP had decided that the person received an overpayment of carer’s allowance during the period 2019 to date; and that the DWP had decided to recover that overpayment;
and
b. One of the following should have occurred recently (preferably within the last 6 weeks):
- i. they received the notice, or instead became aware because a direct deduction was made to their Universal Credit;
- ii. they received the result of a mandatory reconsideration of the decision to recover overpayments;
- iii. they received the result of a challenge to a decision to recover overpayments in the FTT or Upper Tribunal.
